In accessing this Web site and the content of the Mould Compendium fact sheets, you accept these terms. “INSPQ” designates theInstitut national de santé publique du Québec, the legal person established by the Act respecting Institut national de santé publique du Québec (R.S.Q., I-13.1.1).

1. The content of the descriptive fact sheets does not constitute a medical opinion

The content of the fact sheets of the Mould Compendium available on line on this site is offered for information purposes only. Under no circumstances does it replace a medical opinion, diagnosis or treatment. If you have any questions about a situation or a medical treatment relating to the Mould Compendium fact sheets, please communicate with your physician or a qualified health professional. Do not ignore a professional medical opinion and do not wait to consult a physician based on the information contained in the Mould Compendium fact sheets.

2. Disclaimer

The information contained on this site must not be used for purposes other than those clearly identified, namely a set of information relating to moulds in the indoor environment. The Institut national de santé publique du Québec reserves the right to modify or remove the content or any element without previous notice.

The INSPQ, its employees, officers and directors assume no responsibility relating to the consultation and use of the information found on this site.

As a result, the INSPQ, its employees, officers and directors shall not be responsible for the content of the articles cited in this document nor for any other information transmitted through this site.

The INSPQ makes no representations or warranties regarding the accuracy, reliability, completeness or currency of the content, including texts, graphics, links or communications provided in the fact sheets of the Mould Compendium contained on this site or through it, and regarding the conformity of this material to government regulations relating to building contamination by moulds.

The user agrees to indemnify, fully protect, and hold harmless the INSPQ, its directors, employees and content suppliers from and against any monetary judgement in capital, interest, legal and extralegal costs and any other damages including, but without limitation, all reasonable legal costs incurred by the INSPQ relating to any claims, suits, actions or demands resulting from the user’s non-compliance with the present terms of use.

3. Protection of intellectual property rights

a) Authorization required

The material on this Web site, as well as on all sites identified in the name of the government of Québec, is owned by the latter, which holds exclusive intellectual property rights to it. Unless mentioned otherwise, the government’s rights extend to all documents, data, compilations and other works that it produces, publishes or disseminates, including all official or administrative texts (laws and regulations, annual reports, brochures, etc.), whether produced by its employees, a government department, a public organization or a third party who has transferred to the government his rights or has conferred on it a user licence. These rights include copyrights, trademarks, and patents.

The information and compilations contained in the government sites are works protected by copyright in the same manner as multimedia, literary, musical and artistic works.

Moreover, when using these works, in the widest sense of the term, anyone who removes the name of the holder of these rights or modifies the contents by addition, deletion or otherwise, infringes on the moral rights of the holder.

b) Certain uses permitted

4. Integrity of the information

The INSPQ guarantees the integrity of the information at the moment it is posted on the site but not at any later date. Also, in the event of a discrepancy between an official text and the content of this site, the official text shall prevail.

5. Publicity and links to other sites

Total or partial reproduction of the texts and images of the Mould Compendium on any medium whatsoever, as well as the use of the name Mould Compendium or any allusion to the Mould Compendium site for commercial or publicity purposes are strictly prohibited under penalty of law.

The INSPQ does not endorse the content of third-party Web sites. The INSPQ is not responsible for the content of the third-party sites that are linked to those of the INSPQ, and the advertisements disseminated by third parties, and makes no representation regarding their content or their accuracy. Your use of the third-party sites is at your own risk and is subject to the terms of use of those sites. The INSPQ does not endorse any product that may use the content of the Mould Compendium fact sheets as reference.

6. Applicable laws and competent court

These terms of use are governed by the law applicable in Québec, and in the event of a dispute, the tribunals and courts of Québec shall have sole jurisdiction.
